In most situations, yes. Under the New Zealand Building Code – Clause F5 (Construction and Demolition Hazards), where construction or demolition work presents a hazard in places to which the public has access, barriers must be provided.

Clause F5.3.2 requires that barriers:

• Be of appropriate height and construction to prevent harm to traffic or passersby

• Be difficult to climb

• Have no unauthorised openings

• Have no gates or doors that project beyond the site when opened

• Contain no projections that would create a hazard

• Be clearly marked if the barrier itself may present a hazard

This means that if a construction site poses any risk to the public – such as falling objects, open excavations, machinery movement, or restricted access areas – fencing or barriers are required as a control measure. In addition, under the Health and Safety at Work Act (HSWA), businesses must eliminate or minimise risks to workers and others. Temporary fencing is one of the primary methods used to control access and prevent unauthorised entry to hazardous areas.

While the Building Code does not prescribe a specific fence type or height, most construction sites use 1.8m temporary fencing panels as a practical way to meet these performance requirements. This can vary from site to site though based on a risk assessment, hazard identification, likelihood of an incident, incident severity, and other relevant controls and hazards present in the work site. For some sites with lower risk works being executed, shorter 1.2m high construction barriers may be suitable and easier to work with.
